REGULATIONS AND JURISDICTIONS

Since the state of Texas does not have an approved state OSHA program, worker safety regulations are regulated under the guidance of the Federal Occupational Safety and Health Administration. Under the General Duty Clause of the OSH Act, all employers, no matter what size, are required, by law, to provide a safe and healthy environment for their workers. Further regulations are enumerated in CFR Part 29 which document extensive requirements for prevention, documentation and management of safety and health risks. These include the following sections:

29 CFR 1903 – OSHA workplace poster requirements
29 CFR 1904 – OSHA Injury and Illness record keeping requirements
29 CFR 1910 – General Industry Safety Standards
29 CFR 1926 – Construction Industry Safety Standards

Federal OSHA has jurisdiction over most private employers in the state of Texas. Federal employers in TX also operate under the jurisdiction of Federal OSHA. There are two OSHA area offices located in the West Texas area:

Lubbock District Office
1205 Texas Avenue, Room 806

El Paso Area Office
U.S. Dept. of Labor – OSHA
4849 N. Mesa, Suite 200
